    As per Government Order cited, Government have delegated power to the Deputy Directors of Education concerned, to grant height exemption to all types of existing school buildings, subject to the satisfaction that the reduction of height will not affect the conduct of the classes. The Director of General Education has sought clarification as to whether the power delegated to the Deputy Directors of Education to grant height exemption can be extended to buildings constructed after 1991 also. 

    ̂Government have examined the matter in detail and are pleased to delegate the power to the Deputy Directors of Education concerned, to grant height exemption to all types of existing school buildings, constructed after 1991 also, provided the Deputy Director of Education   concerned shall ensure that the reduction of height will not affect the conduct of the classes and deviation from the specification is minimal and reasonable. The educational officers concerned shall ensure that the school buildings which are given fitness from this date of order  shall have the specifications as per Kerala Education Rules.̂

    എയ്ഡഡ് ഭിന്നശേഷി സംവരണം – ബാക്ക് ലോഗ് നിയമനം സംബന്ധിച്ച റോസ്റ്റര്‍ പരിശോധിച്ച് കണ്‍ഫെം ചെയ്യുന്നതിനുള്ള മാര്‍ഗ്ഗനിര്‍ദ്ദേശങ്ങള്‍ പുറപ്പെടുവിക്കുന്നു.

    • 1) 'സമന്വയ' -യിൽ വിദ്യാഭ്യാസ ഓഫീസർമാരുടെ ലോഗിനുകളിൽ RPWD Roster ലഭ്യമാണ്. അതാത് വിദ്യാഭ്യാസ ഓഫീസുകൾക്ക് കീഴിൽ വരുന്ന സ്കൂ‌ളുകളിൽ നടത്തിയ നിയമനങ്ങൾ സംബന്ധിച്ച വിവരങ്ങൾ, ലഭ്യമായ രേഖകൾ പരിശോധിച്ച് ആയതിൻ്റെ ആധികാരികത ഉറപ്പുവരുത്തേണ്ടതാണ്. പരിശോധനയിൽ ഏതെങ്കിലും എൻട്രിയിൽ അപാകത കണ്ടെത്തിയാൽ ആ എൻട്രിക്ക് നേരെയുള്ള more എന്ന ബട്ടൺ ക്ലിക്ക് ചെയ്ത് ലഭ്യമാകുന്ന റിമാർക്സ് ബോക്‌സിൽ അപാകത സംബന്ധിച്ച രേഖപ്പെടുത്തൽ നടത്തി സേവ് ചെയ്ത്, റോസ്റ്റർ റീ സെറ്റ് ചെയ്‌തതിനുശേഷം പ്രസത വിവരം മാനേജരെ അറിയിക്കേണ്ടതാണ്. മാനേജർ ആവശ്യമായ തിരുത്തൽ വരുത്തി വീണ്ടും കൺഫേം ചെയ്യേണ്ടതും ബന്ധപ്പെട്ട വിദ്യാഭ്യാസ ഓഫീസർ, അപാകത പരിഹരിച്ചു എന്ന് ഉറപ്പുവരുത്തി verify ബട്ടൺ ക്ലിക്ക് ചെയ്ത് രേഖപ്പെടുത്തലുകൾ ആധികാരികമാക്കേണ്ടതുമാണ്.
    • 2) വിദ്യാഭ്യാസ ഓഫീസർമാർക്കും മാനേജർമാർക്കും തങ്ങളുടെ ലോഗിനുകളിൽ ഏതെല്ലാം സ്കൂ‌ളുകളിലെ വെരിഫിക്കേഷനുകൾ പൂർത്തിയായിട്ടുണ്ട് എന്നത് അറിയാവുന്നതാണ്. 
    • 3) വിവിധ ഓഫീസുകൾക്ക് കീഴിൽ സ്‌കൂളുകളുള്ള മാനേജ്‌മെന്റുകൾ സമർപ്പിച്ച റോസ്റ്റർ ഡാറ്റ ഏതെങ്കിലും ഒരു ഓഫീസിൽ റീസെറ്റ് ചെയ്യുന്നത് മൂലം മറ്റ് ഓഫീസുകളിൽ നിന്നും നടത്തിയ വെരിഫിക്കേഷനുകൾ നഷ്‌ടപ്പെടുന്നതല്ല. 
    • 4) മാനേജർമാർ റോസ്റ്റർ പൂർത്തീകരിച്ച് സമർപ്പിക്കുകയും, സ്പെഷ്യൽ എംപ്ലോയ്മെന്റ് എക്സ്‌ചേഞ്ചിലേക്ക് ആനുപാതികമായി ഒഴിവുകൾ റിപ്പോർട്ട് ചെയ്യുകയും ചെയ്തിട്ടുണ്ട് എന്ന് ഉറപ്പുവരുത്തിയും, സ്പെഷ്യൽ എംപ്ലോയ്മെന്റ്റ് എക്സ്ചേഞ്ചിലേക്ക് ഭിന്നശേഷി ഉദ്യോഗാർത്ഥികളെ ആവശ്യപ്പെട്ടുകൊണ്ടുള്ള റിക്വിസിഷൻ്റെ കൈപ്പറ്റു രസീതിയോ/ non availability സർട്ടിഫിക്കറ്റോ ഹാജരാക്കുകയും ചെയ്യുന്ന മുറക്ക് നിലവിൽ അംഗീകാരം ഇല്ലാതെ തുടരുന്ന നിയമനങ്ങൾ, സർക്കാർ ഉത്തരവുകളിലേയും, സർക്കുലറുകളിലേയും വ്യവസ്ഥകൾ പ്രകാരം അംഗീകാരത്തിനു പരിഗണിക്കേണ്ടതാണ്. ഇതിനായി റോസ്റ്റർ പരിശോധന പൂർത്തിയാക്കുന്നതുവരെ കാത്തിരിക്കേണ്ടതില്ല. 
    • 5)സമന്വയിൽ ഇതുവരെ റോസ്റ്റർ സമർപ്പിക്കാത്ത മാനേജർമാർ ആയത് ഉടനെ തന്നെ സമന്വയയിൽ സമർപ്പിക്കേണ്ടതും, ആയത് പ്രകാരം ബാക്ക്‌ലോഗ് പരിഗണിക്കാനുള്ള റിക്വിസിഷൻ സ്പെഷ്യൽ എംപ്ലോയിമെന്റ്റിൽ സമർപ്പിക്കേണ്ടതുമാണ്. ഇപ്രകാരം മാനേജർമാർ നിലവിൽ സമന്വയയിൽ സമർപ്പിച്ചിട്ടുള്ള റോസ്റ്റർ ഡാറ്റ, പരിശോധിച്ച് കൺഫേം ചെയ്യേണ്ടതും, സ്പെഷ്യൽ എംപ്ലോയ്മെൻ്റ് എക്സ്ചേഞ്ചിലേക്ക് സമർപ്പിക്കേണ്ടതുമാണ്. ഇപ്രകാരം നടപടിക്രമം പൂർത്തികരിച്ച  മാനേജർമാർ നടത്തിയ നിയമനങ്ങൾക്ക്  പ്രൊവിഷണൽ(താൽക്കാലിക)അംഗീകാരം) നൽകുന്നതിനുള്ള നടപടികൾ 30/06/2023 നകം ബന്ധപ്പെട്ട വിദ്യാഭ്യാസ ഓഫീസർമാർ പൂർത്തീകരിക്കേണ്ടതാണ്. 
    • 6)റോസ്റ്റർ ഡാറ്റ പരിശോധിച്ചതിൻ്റെ അടിസ്ഥാനത്തിൽ, ആവശ്യമായ ഭിന്നശേഷി നിയമനം നടത്തിയെന്ന് ഉറപ്പുവരുത്തിയതിനുശേഷം / സൂചന (1) സർക്കാർ ഉത്തരവിൽ നിർദ്ദേശിച്ചിട്ടുള്ള നടപടിക്രമങ്ങളെല്ലാം പാലിച്ചതിനുശേഷം, സംവരണ നിയമനത്തിനായി ഭിന്നശേഷി ഉദ്യോഗാർത്ഥിയെ ലഭിക്കുന്നില്ലായെങ്കിൽ പരാമർശപ്രകാരമുള്ള സർക്കാർ ഉത്തരവുകൾക്കും സർക്കുലറുകൾക്കും അനുസൃതമായി ശമ്പള സ്കെയിലിൽ നൽകിയ താൽക്കാലിക നിയമനാംഗീകാരങ്ങളും ദിവസവേതനാടിസ്ഥാനത്തിലുള്ള നിയമനാംഗീകാരങ്ങളും നിയമനത്തീയതി മുതൽ തന്നെ ശമ്പളസ്കെയിലിൽ ബന്ധപ്പെട്ട വിദ്യാഭ്യാസ ഓഫീസർമാർ റഗുലറൈസ് ചെയ്‌ത്‌ നൽകേണ്ടതാണ്.

    Amendment of the Rules. In Part I of the Kerala Service Rules, for rule 86A, the following shall be substituted, namely:- "86A. Notwithstanding anything contained in Rules 84, 86, 88 (ii) and 90, an officer not in permanent employ who has completed three years of continuous service shall be eligible for (i) commuted leave, (ii) earned leave and (iii) leave without allowances as would be admissible to him if he had held his post substantively".

    Explanatory Note (This does not form part of the Notification, but is intended to indicate its general purport.) As per Rule 86 Part I Kerala Service Rules, earned leave admissible for the first year of service is 1/22 of the period spent on duty. Recasting of earned leave at the rate of 1/11 for the first year is permissible only after an officer is confirmed in service. Due to the absence of sufficient number of permanent posts, many employees are denied confirmation making them ineligible to get their earned leave for the first year recast at the rate of 1/11 of the duty. Since this causes monetary loss to employees, Government have decided to make suitable modification to Rule 86A so that those who have completed 3 years service will become eligible for earned leave at the rate of 1/11 for the period spent on duty for the first year of service as admissible to a permanent employee. This notification is intended to achieve the above object.

        As per the Rule 37(b) of Part I of the Kerala Service Rules, in the case of officiating appointments from a higher time scale of pay to lower time scale of pay in accordance with the Special Rules applicable to such appointments, the officer's officiating pay in the new time scale shall be fixed at his officiating pay in the previous appointment, if it is a stage in the new time scale or at the next lower stage, if it is not a stage in the new time scale, the difference being treated as personal pay to be absorbed in future increases. As per the rules of fixation in the Kerala Service Rules where re-fixation is permissible, re-fixation is granted on the date of increment of the lower post. There is no rule in the Kerala Service Rules which permit re-fixation on appointment from higher time scale of pay to lower time scale of pay. Since there is no lower post with reference to which re-fixation can be sanctioned in the case of appointments from higher time scale of pay to lower time scale of pay in accordance with the Special Rules. no re-fixation is permissible in such cases. However there is no specific mention about eligibility for re-fixation in such cases in Rule 37(b) of Part 1 the Kerala Service Rules. Government have examined the matter in detail and are pleased to order that in cases of appointments from higher time scale of pay to lower time scale of pay in accordance with the Special Rules, no re-fixation will be allowed as there is no lower scale with reference to which re-fixation can be sanctioned. Past cases settled otherwise will not be re-opened. Necessary modification to the Kerala Service Rules will be issued seperately.

    •   Amendment of the Rules.In Part I of the Kerala Service Rules, after rule 81, the following rule shall be inserted, namely:--- "81 A. The earned leave admissible to an officer in permanent employ in the vacation department, who is prevented from availing himself of vacation in full and whose actual period of duty is less than one year due to superannuation, shall be calculated in such proportion for full block year as the number of days of actual duty bears to the full year. The amount of earned leave admissible shall be worked out under the formula given below,- "Number of days of vacation duty x 30 x Days of actual duty Full vacation 365/366
    • Explanatory Note (This does not form part of the notification, but is intended to indicate its general purport.) As per the present formula, derived in terms of provisions in rule 81 Part ! Kerala Service Rules, for calculation of earned leave in vacation department for the period for which an officer is prevented from availing himself of vacation in full represents that for 12 months of actual duty in the department and is not applicable for vacation duty in the case of officers whose actual duty is less than one block year. Hence Government have decided to insert Rule 81 A for calculation of carned leave admissible to those who performed vacation duty in part and who could not complete 12 months of actual duty in the last year of service due to superannuation, for which Kerala Service Rules Part I has to be amended, This notification is intended to achieve the above object

    The provisional service with or without break rendered by the employees upto 30.9.1994 which qualifies for  earning increments in terms of Govt.  Decision No.2 under Rule 33 Part I Kerala Service Rules will be reckoned as Qualifying Service for pension irrespective of dates of retirement after 20.11.89.  The provisional service rendered on or after 1.10.1994 will not be reckoned as qualifying service for pension.
