APPOINTMENT FROM HIGHER TIME SCALE OF PAY TO LOWER TIME SCALE OF PAY IN ACCORDANCE WITH THE SPECIAL RULES - NO RE-FIXATION ORDERS ISSUED.:GO(P)25/2025/FIN DT:15/03/2025
As per the Rule 37(b) of Part I of the Kerala Service Rules, in the case of officiating appointments from a higher time scale of pay to lower time scale of pay in accordance with the Special Rules applicable to such appointments, the officer's officiating pay in the new time scale shall be fixed at his officiating pay in the previous appointment, if it is a stage in the new time scale or at the next lower stage, if it is not a stage in the new time scale, the difference being treated as personal pay to be absorbed in future increases. As per the rules of fixation in the Kerala Service Rules where re-fixation is permissible, re-fixation is granted on the date of increment of the lower post. There is no rule in the Kerala Service Rules which permit re-fixation on appointment from higher time scale of pay to lower time scale of pay. Since there is no lower post with reference to which re-fixation can be sanctioned in the case of appointments from higher time scale of pay to lower time scale of pay in accordance with the Special Rules. no re-fixation is permissible in such cases. However there is no specific mention about eligibility for re-fixation in such cases in Rule 37(b) of Part 1 the Kerala Service Rules. Government have examined the matter in detail and are pleased to order that in cases of appointments from higher time scale of pay to lower time scale of pay in accordance with the Special Rules, no re-fixation will be allowed as there is no lower scale with reference to which re-fixation can be sanctioned. Past cases settled otherwise will not be re-opened. Necessary modification to the Kerala Service Rules will be issued seperately.
