Amendment of the Rules. In Part I of the Kerala Service Rules, for rule 86A, the following shall be substituted, namely:- "86A. Notwithstanding anything contained in Rules 84, 86, 88 (ii) and 90, an officer not in permanent employ who has completed three years of continuous service shall be eligible for (i) commuted leave, (ii) earned leave and (iii) leave without allowances as would be admissible to him if he had held his post substantively".
Explanatory Note (This does not form part of the Notification, but is intended to indicate its general purport.) As per Rule 86 Part I Kerala Service Rules, earned leave admissible for the first year of service is 1/22 of the period spent on duty. Recasting of earned leave at the rate of 1/11 for the first year is permissible only after an officer is confirmed in service. Due to the absence of sufficient number of permanent posts, many employees are denied confirmation making them ineligible to get their earned leave for the first year recast at the rate of 1/11 of the duty. Since this causes monetary loss to employees, Government have decided to make suitable modification to Rule 86A so that those who have completed 3 years service will become eligible for earned leave at the rate of 1/11 for the period spent on duty for the first year of service as admissible to a permanent employee. This notification is intended to achieve the above object.
